PCNs have to follow strict procedural rules under the Traffic Management Act 2004 and the relevant regulations. Late service, missing information on the Notice to Owner, or an incorrect contravention code can all invalidate the penalty.

Mitigating circumstances

Transport for London has discretion to cancel a PCN where there are exceptional circumstances — a medical emergency, a vehicle breakdown, a Blue Badge that fell off the dashboard, or a pay-and-display machine that was out of service. A well-evidenced mitigation letter can be raised at the informal-representations stage.
