How to Challenge a Private Parking Charge in Ireland

APCOA, Park Magic, Park Rite, Euro Car Parks Ireland and others run private car parks across Ireland. Their charges are contractual — not FCNs — and have different appeal grounds.

Contract law, not road traffic law

A private parking charge in Ireland is a contractual claim, not a Fixed Charge Notice. The operator must prove (a) you entered into a contract by parking on their land where signage was clear, and (b) the charge is a genuine pre-estimate of loss or otherwise reasonable. Unfair contract terms can be challenged under the Consumer Rights Act 2022 (Ireland).

Signage must be prominent at the entrance

Clear, prominent signage at the car-park entrance setting out the terms (time limit, charge for breach, contact details) is essential. If you could not see the signage from your driving position, no contract is formed.

PSA licence and operator code of practice

The operator must hold a current Private Security Authority licence. Code-of-practice breaches (no grace period, exorbitant charges, lost-ticket charges out of proportion) are valid grounds to challenge.

Can a private operator issue penalty points?

No. Penalty points are statutory and only attach to Garda-issued offences. Private parking charges are purely contractual.

Will a private operator sue me in Ireland?

It is rarer than in the UK but rising. Operators occasionally pursue claims through the Small Claims Court or Circuit Court.

Do I have to give the operator the driver's details?

Irish keeper-liability rules are weaker than UK PoFA 2012 — there is no Irish statutory equivalent. The operator usually cannot recover from the registered keeper unless the keeper was the driver.
