Contract law, not road traffic law
A private parking charge in Ireland is a contractual claim, not a Fixed Charge Notice. The operator must prove (a) you entered into a contract by parking on their land where signage was clear, and (b) the charge is a genuine pre-estimate of loss or otherwise reasonable. Unfair contract terms can be challenged under the Consumer Rights Act 2022 (Ireland).
Signage must be prominent at the entrance
Clear, prominent signage at the car-park entrance setting out the terms (time limit, charge for breach, contact details) is essential. If you could not see the signage from your driving position, no contract is formed.
PSA licence and operator code of practice
The operator must hold a current Private Security Authority licence. Code-of-practice breaches (no grace period, exorbitant charges, lost-ticket charges out of proportion) are valid grounds to challenge.
