The default rule under Road Traffic Act 1994
Section 103 treats payment of an FCN as acceptance of the alleged contravention. Once paid, the issuing authority will not consider representations and the matter is closed for the State.
Exception 1 — payment by mistake
If you paid the wrong FCN (e.g. you had two FCNs and paid the one you wanted to contest), or if you paid in response to a fraudulent demand, the council should refund the misallocated amount and your appeal rights for the unpaid FCN remain.
Exception 2 — discretionary refund for procedural defects
Some Irish councils will exercise discretion to refund a paid FCN where a clear procedural defect is later identified — defective service, wrong vehicle, wrong contravention code. Write to the parking section with the evidence and a polite request.
