Mitigating Circumstances That Can Cancel an FCN

Irish councils have discretion to cancel an FCN where there are exceptional circumstances. Here are the categories that succeed when properly evidenced.

Medical emergency

Parking on a yellow line to assist a medical emergency, transport a patient, or attend an unexpected hospital event is a recognised mitigating circumstance. Provide a hospital admission letter, GP letter, or ambulance record.

Vehicle breakdown

A genuine breakdown that left you with no alternative parking is recognised. Submit a copy of the recovery-service callout (AA, RAC, Garda assistance) with the time and location matching the FCN.

Disability and access

Blue Badge holders displaying a valid disability permit are exempt from most timed-parking restrictions. If the permit was displayed but the enforcement officer missed it, a copy of the permit with the FCN reference is usually enough.

Is "I was only there for five minutes" a mitigation?

Not on its own. Duration is not a statutory factor for most contraventions; the offence is the parking itself. Combine duration with another ground (sign obscured, no realistic alternative) for impact.

Can I claim mitigation if I forgot to display my disc?

Sometimes. Some authorities (especially Dublin City Council) accept a one-off discretionary cancellation for a forgotten permit if you can show you held a valid permit at the time. Send a photo of the valid permit and a polite explanation.

Does work-related parking count as mitigation?

No. Work pressure, late deliveries, and "I had a meeting" are not statutory mitigations. Loading and unloading exemptions in S.I. 182/1997 may apply if you were actively delivering goods.
