Fleet Vehicle KADOE Data — Operator Must Query DVLA for Keeper

When a private parking charge is issued to a fleet or lease vehicle, the operator can only hold the registered keeper liable under Schedule 4 of the Protection of Freedoms Act 2012 if it applied to the DVLA for the keeper's details for the date of the event (the KADOE route) within the strict statutory window and actually received that information (the 'third condition', paragraph 11). If the operator skipped the DVLA application, relied on other records, or ignored the lease company's hire paperwork identifying the hirer (paragraphs 13-14), keeper liability fails. Note: this defeats liability against the keeper only — the operator may still pursue whoever was driving, so never identify the driver.
