Stolen Vehicle Defence

If your vehicle was stolen at the time of the alleged parking contravention, you cannot be held liable as keeper.

Legal basis

POFA 2012 Schedule 4 Paragraph 4(2)(b) - keeper liability does not apply if 'the vehicle was a stolen vehicle at the beginning of the period of parking'.

How to identify this in your case

Provide police crime reference number for vehicle theft report covering the date in question.

Sample appeal wording

The vehicle was stolen before the alleged parking contravention occurred. I reported this theft to the police on [DATE] (crime reference: [NUMBER]). POFA 2012 Schedule 4 Paragraph 4(2)(b) explicitly provides that the right to recover parking charges from the keeper does not apply if 'the vehicle was a stolen vehicle at the beginning of the period of parking'.
