Private parking keeper liability does not apply in Scotland
In Scotland, private parking companies cannot make the registered keeper of a vehicle pay a parking charge just because they own the car. The company must identify who was actually driving and pursue that person instead. If you were not the driver, you are not liable.
Legal basis
POFA 2012 Schedule 4 applies only to England & Wales. Scotland has no equivalent keeper liability provision.

Check where the parking event happened. If it was in Scotland and the company is chasing you as the registered keeper rather than as the driver, this defence applies to you.
