London moving traffic — failure to comply with traffic light at LTN/LIP — emergency exception
Low Traffic Neighbourhood (LTN) and Liveable Neighbourhood schemes use cameras to enforce restrictions on motor vehicle entry. Most LTN TROs include emergency vehicle and resident-emergency exemptions. PCNs issued where genuine emergency or unavoidable detour caused entry can be challenged. Many LTNs implemented via ETO have also faced JR — same procedural defect points apply.
Legal basis
Traffic Management Act 2004 Part 6; RTRA 1984 ss.1, 9; relevant borough's LTN TRO/ETO; DfT Statutory Guidance 2022; Equality Act 2010
How to identify this in your case
999/111 call log; carer/family emergency evidence; satnav screenshot of diversion. ETO procedural records.
Sample appeal wording
Dear Sir/Madam, Re: PCN [NUMBER] — LTN/Liveable Neighbourhood — [DATE] I challenge this PCN. At [TIME] I entered [STREET] in genuine emergency circumstances: [Describe — '999 was called for [person] at [ADDRESS]; I was the responding family member. Call log attached.'] The [Borough] LTN Order includes an emergency exemption (alternatively, the Council must exercise discretion under DfT Statutory Guidance March 2022). [If applicable: I am also a Blue Badge holder / registered carer; Equality Act 2010 reasonable adjustment duty engages.] Please cancel the PCN. Yours faithfully, [NAME]
