LEZ — DVLA Euro grade recorded wrongly for your vehicle

Low Emission Zone cameras check your vehicle's Euro emission grade using DVLA records. Sometimes that record is wrong — for example, if your vehicle was imported, has had its engine replaced with a cleaner one, has been fitted with approved pollution-reducing equipment, or is a motorcycle, hybrid van, or historic vehicle converted to electric. If your vehicle actually meets the required standard (Euro 6 for diesel, or Euro 4 for petrol), you did not break the rule — regardless of what the DVLA record says. You will need to provide evidence proving your vehicle's true emission standard.

Legal basis

Transport (Scotland) Act 2019 s.6(1)(a); SSI 2021/177 reg 2 and reg 8(4)(a)

How to identify this in your case

Vehicle has CVRAS certificate; engine has been replaced; DVLA Euro field is blank/wrong; import has documents showing higher Euro standard.

Sample appeal wording

Dear [COUNCIL] LEZ Team, Re: PCN [PCN_NUMBER] Representation under reg 8(1); ground reg 8(4)(a). The PCN was issued because DVLA Euro classification for [VRN] is recorded as [LISTED_EURO]. That record is incorrect. The vehicle in fact meets [Euro 6 diesel / Euro 4 petrol]: [Choose:] — Retrofitted with CVRAS-accredited abatement under [SCHEME_REF], certificate enclosed; — Re-engined on [DATE] with [ENGINE_TYPE] meeting [EURO_STD]; V5C amendment (BS-7) and engine code [CODE] enclosed; — [YEAR] [MAKE] [MODEL] manufactured to [EURO_STD]; manufacturer's certificate of conformity (Annex IX EC type-approval) enclosed. The vehicle is therefore not one to which s.6(1) applies. Please cancel and amend your DVLA enquiry process. Yours faithfully, [NAME]
