Fixed Charge Notice contains wrong details or bad image

A Fixed Charge Notice for a bus-lane offence must correctly show your vehicle's registration, the exact location, the date, and the time. It must also be backed by a camera image that clearly shows your vehicle inside the bus lane while it was in operation. If any of those details are wrong, or the image does not actually show that, the notice is defective.

Legal basis

Road Traffic Act 1994, s.35 and the fixed-charge notice procedure — the notice must correctly state the offence particulars.

How to identify this in your case

Check every detail on the Fixed Charge Notice against what you know to be true. Then request the camera image or other evidence. Ask yourself: does the image clearly show your vehicle in the bus lane during its operating hours? If any detail is wrong or the image fails to show this, this ground may apply to you.
