DVA Not DVLA — Keeper Data Harder for Private Operators to Obtain in NI

In Northern Ireland, vehicle registration and keeper information is held by the Driver and Vehicle Agency (DVA), not the DVLA. Many private parking operators are accredited with DVLA and make keeper enquiries through DVLA's systems. These enquiries will not return NI keeper data held by DVA. An operator who cannot obtain keeper data through DVA accreditation cannot establish who the keeper is, making enforcement significantly harder.

Legal basis

Vehicle Excise and Registration Act 1994; DVA (Northern Ireland) registration procedures; UK GDPR

How to identify this in your case

You are registered as keeper of a vehicle in Northern Ireland (NI registration or NI address). The parking charge notice was issued by a private operator. Ask them to confirm they made a DVA keeper enquiry — many cannot as they are only DVLA-accredited.

Sample appeal wording

I am writing to dispute parking charge notice [reference] and to make enquiries regarding your data processing. Vehicle [registration] is registered in Northern Ireland and keeper records are held by the Driver and Vehicle Agency (DVA), not the DVLA. Please confirm: 1. Whether you hold accreditation to access DVA keeper records 2. Whether you made a formal DVA keeper enquiry in respect of this vehicle 3. If not, the source from which you obtained my personal data If you obtained my details other than through a legitimate DVA keeper enquiry, you have processed my personal data without a lawful basis under UK GDPR, rendering this notice unenforceable. I reserve the right to report any data breach to the Information Commissioner's Office. This charge is disputed in full. I await your response before taking further action.
