DfI signage — TSRGD does not apply; bespoke NI Traffic Signs Regulations

TSRGD 2016 (England, Scotland, Wales) does not apply in Northern Ireland. Signs in NI must comply with the Traffic Signs Regulations (Northern Ireland) 1997 (SR 1997/386) as amended, the Traffic Signs Regulations and General Directions (Northern Ireland) 2017 in part, and the DfI Traffic Signs Manual (NI). Signs that are of an English TSRGD design but not approved under NI Regulations are non-compliant and not 'lawfully placed' for the purposes of NI civil enforcement.

Legal basis

Traffic Signs Regulations and General Directions (Northern Ireland) 1997 (SR 1997/386); Road Traffic Regulation (Northern Ireland) Order 1997 Art 28; Roads (Northern Ireland) Order 1993 Art 10

How to identify this in your case

Photograph the sign. Compare to NI-approved diagrams in DfI Traffic Signs Manual. Look for English-only TSRGD diagrams not adopted in NI.

Sample appeal wording

Dear Sir/Madam, Re: PCN [PCN_NUMBER] The sign relied upon at [LOCATION] is not a sign of a description prescribed by the Traffic Signs Regulations (Northern Ireland) 1997 nor authorised by direction of the Department under Article 28 of the Road Traffic Regulation (NI) Order 1997. TSRGD 2016 (which is the English version) does not apply in Northern Ireland. The sign is therefore not lawfully placed and the contravention cannot be made out. Please cancel the PCN. Yours faithfully, [NAME]
