You Were Not Told How to Appeal Independently

After you challenge a private parking ticket with the company directly, they must tell you about the free, independent appeals service — POPLA (used by BPA members) or IAS (used by IPC members) — and give you what you need to use it. If they left that out, this gives you two separate arguments, and it helps to keep them apart. First, keeper liability: under the Protection of Freedoms Act 2012, Schedule 4 (paragraphs 9(2)(g) and 9(8)), the Notice to Keeper must set out the arrangements for resolving disputes, including referral to independent adjudication. If it does not, the company loses its right to demand payment from you as the registered keeper — it can then only pursue whoever was driving, and it has to prove who that was. Second, code breach: the Single Code of Practice (BPA/IPC, in force since 1 October 2024) requires the company, when it rejects your challenge, to tell you how to take the case to the independent appeals service (section 8.4.6), and to pause enforcement and debt recovery while that appeal runs (section 8.4.7) — so being passed straight to a debt collector instead is itself a breach. A code breach does not by itself cancel the charge, but it is a strong point before POPLA or the IAS and a proper subject for a complaint to the operator's trade association.
