Wrong appeals body named on Scottish parking notice

Scotland handles parking-charge appeals through its own routes, but not the way this ground was originally written. PRIVATE parking charges in Scotland go to the same independent appeals services as the rest of Great Britain — POPLA (for operators in the British Parking Association) or the IAS (for operators in the International Parking Community). POPLA has accepted Scottish private-parking appeals since 1 May 2019, so a PRIVATE notice that tells you to appeal to POPLA is CORRECT, not an error. Private parking: under the industry Single Code of Practice (Code in force 1 October 2024; v1.1 in force 17 February 2025), clause 8.1.2 the notice must inform the recipient of the process by which they may appeal and that, if the operator rejects the appeal, there is a further right of appeal to the Appeals Service; clause 8.4.6 requires the operator, on rejecting an appeal, to present the option of appealing to the relevant Appeals Service; and clause 2.2 defines that service as POPLA for BPA members and the Independent Appeals Service for IPC members; POPLA (BPA members) and the IAS (IPC members) both handle Scottish appeals. Council parking: appeal rights run to the First-tier Tribunal for Scotland (General Regulatory Chamber), Parking and Bus Lane Appeals (Rules of Procedure) Regulations 2020, after the council rejects your written challenge. This is an industry-code / procedural point, not a statutory cancellation right. Note separately: private-parking keeper liability under the Protection of Freedoms Act 2012 does not extend to Scotland — that is a different and stronger ground than this one.

Keep the record. Keep what you sent, the attachments, any receipt, and the reply. Note the next deadline.
