Ticket Issued Outside the Restriction Hours

A parking restriction only bites during the hours on the sign, so if your vehicle was there outside those hours there was no contravention. But be careful which time you argue from, because getting this wrong hands the council an easy answer. What matters is the time of the CONTRAVENTION — the time recorded on the notice as the moment the vehicle was in breach — not the time the officer finished writing the ticket. An officer can observe a vehicle in contravention at 18:25 and hand over or fix the notice at 18:32, and the notice is good. So check the contravention time on the notice against the hours on the sign. If the contravention time itself falls outside the restricted hours, say so plainly: the contravention did not occur. If the only thing outside the hours is the issue time, that on its own proves nothing. Some contraventions also require the officer to observe for a set period first, and where the restriction ends during that observation it is worth asking the council for the officer's notes and the observation times.

Legal basis

The restricted hours are set by the local traffic regulation order made under the Road Traffic Regulation Act 1984 (sections 1 and 2 outside Greater London; section 6 within it) and must be indicated by signs prescribed by the Traffic Signs Regulations and General Directions 2016. Outside the restricted hours the order imposes no prohibition, so no contravention arises. The ground of representation is "the alleged contravention did not occur" — regulation 5(4)(a) of the Civil Enforcement of Road Traffic Contraventions (Representations and Appeals) (England) Regulations 2022 (SI 2022/576). How to identify this in your case

Find the CONTRAVENTION time on the notice — not the time the notice was issued or printed — and compare it with the hours on the sign or time plate where you parked. This ground applies if the contravention time itself falls outside those hours. It does not apply merely because the officer finished writing the ticket after the restriction ended: an officer can observe a contravention at 18:25 and complete the notice at 18:32, and the notice stands. If the contravention required an observation period and the restriction ended during it, ask the council for the officer's notes.

Careful what you volunteer. Avoid unnecessary admissions — naming the driver or accepting responsibility can remove arguments. But answer anything you are legally required to answer, and do include the evidence your ground needs.
Keep the record. Keep what you sent, the attachments, any receipt, and the reply. Note the next deadline.
