TCG 2014 Fees Regulations — fixed-fee scale and stage transitions

Bailiffs (Enforcement Agents) under the Tribunals, Courts and Enforcement Act 2007 Schedule 12 may only charge the fees in the Taking Control of Goods (Fees) Regulations 2014. The fees are FIXED and tied to enforcement stages. For a High Court writ, the stages are: Compliance (£75), First Enforcement (£190 + 7.5% over £1,000), Second Enforcement (£495), Sale or Disposal (£525 + 7.5% over £1,000). For a County Court warrant: Compliance (£75), Enforcement (£235 + 7.5% over £1,500), Sale/Disposal (£110). Any additional 'admin', 'visit', 'attendance' or 'levy' fee is unlawful and recoverable. Fees cannot be charged for a stage that has not lawfully commenced. Compliance stage fee can only be charged once per debt.

Legal basis

Tribunals, Courts and Enforcement Act 2007 Schedule 12; Taking Control of Goods Regulations 2013 (SI 2013/1894); Taking Control of Goods (Fees) Regulations 2014 (SI 2014/1) regs 5-8 and Schedule (fees Table)

How to identify this in your case

You are being chased by a bailiff/enforcement agent for an unpaid private parking CCJ or council PCN warrant. The fee bill includes amounts not in the SI 2014/1 schedule, or the bailiff has charged for a stage they did not lawfully reach (e.g., 'enforcement' fee added without an actual physical attendance at premises).

Sample appeal wording

Dear [BAILIFF / ENFORCEMENT COMPANY], Re: Account [REF] — Vehicle [REG] / Debtor [NAME] I dispute the fees claimed and request a full breakdown under regulation 8 of the Taking Control of Goods (Fees) Regulations 2014 (SI 2014/1) within 7 days. The only fees lawfully recoverable are those set out in the Schedule to SI 2014/1: County Court warrant: - Compliance stage: £75 (one fee per debt) - Enforcement stage: £235 + 7.5% of sum over £1,500 - Sale/Disposal stage: £110 + 7.5% of sum over £1,500 High Court writ: - Compliance: £75 - 1st Enforcement: £190 + 7.5% over £1,000 - 2nd Enforcement: £495 - Sale/Disposal: £525 + 7.5% over £1,000 I note the following defects in your fee claim: - [LIST e.g. 'attendance fee £235 charged without actual visit'; 'two enforcement-stage fees for one debt'; 'admin fee not in Schedule'; 'VAT charged in addition where Sch para 8 specifies inclusive'] Under regulation 16 of the Taking Control of Goods Regulations 2013, I will apply for detailed assessment in the County Court if the unlawful fees are not removed within 14 days. Further, under paragraph 66 of Schedule 12 to the TCEA 2007 I will apply to the County Court for a remedy where the enforcement agent has breached a provision of Schedule 12 or the Regulations. I also reserve the right to complain to the certificating court under regulation 9 of the Certification of Enforcement Agents Regulations 2014 to challenge the agent's certificate. Yours faithfully, [NAME]
