School Streets — emergency / unavoidable entry

Most School Streets TROs include an emergency exemption. Genuine emergencies — medical, unavoidable diversion, breakdown, response to vulnerable resident — provide a complete defence. Even where not formally exempt, councils must exercise discretion fairly per DfT statutory guidance.

Legal basis

Statutory exemption clauses in individual School Streets TROs; TMA 2004 Statutory Guidance on Civil Enforcement of Moving Traffic Contraventions (March 2022); Equality Act 2010 (where disability/access)

How to identify this in your case

Document the emergency: 999 call log, hospital admission record, RAC/AA breakdown receipt, witness statement. Check the council's School Streets order for an emergency clause.

Sample appeal wording

Dear Sir/Madam, Re: PCN [NUMBER] — School Streets — [DATE/TIME] I challenge this PCN. I entered [STREET] at [TIME] in genuine emergency circumstances: [Describe — e.g. 'My elderly mother had collapsed at her home and I was responding to a call from her carer. I called 999 at [TIME] and the ambulance arrived at [TIME]. Call log/admission record attached.'] The [Council] School Streets Order includes an emergency exemption (alternatively, the Council is required under DfT Statutory Guidance on Civil Enforcement of Moving Traffic Contraventions (March 2022) to exercise discretion fairly). I was inside the restricted hours for less than [DURATION] and caused no risk because [reason]. I request the Council exercise its discretion and cancel this PCN. Yours faithfully, [NAME]
