Plate or VIN Mismatch on Citation

When the citation lists a plate/state/VIN/make/model that does not match the registered owner's vehicle, the citation is defective. This is common with one-character OCR errors, transposed digits, or tickets written for similar-looking vehicles. The agency must dismiss when the wrong vehicle is identified.

Legal basis

F.S. §316.650; F.S. §316.1967

Sample appeal wording

TO: [HEARING OFFICER] RE: Citation # [#] The citation identifies vehicle as [PLATE/MAKE/MODEL/COLOR FROM CITATION]. My registered vehicle is [PLATE/MAKE/MODEL/COLOR — copy of registration attached]. The citation does not describe my vehicle. Under §316.650, Fla. Stat., a citation that misidentifies the vehicle cannot be enforced against me. Dismissal is required. [NAME] / [DATE]
