Photo Enforcement Not Personally Served Within 90 Days

Arizona photo-radar (speed) and red-light camera citations must be PERSONALLY served within 90 days of the complaint being filed with the court. A mailed notice alone does not give the court jurisdiction over you. If you are not personally served within that window - and you do not waive service by sending written communication back to the court - the court never acquires personal jurisdiction and the case is dismissed.

Legal basis

A.R.S. 28-1592 (action by filing must be filed within 60 days of the violation and served within 90 days of the filing date); civil-traffic personal-jurisdiction requirement. See also A.R.S. 28-1602.
