Pay-Parking Bye-Laws: Required Steps Not Followed

Before a council can create paid parking rules, it must follow a strict set of steps: consult the Garda Commissioner; publish a public notice in a newspaper; allow at least one month for the public to inspect the draft rules; accept written comments (with a closing date no earlier than two weeks after the inspection period ends); and consider all comments received. The rules must also be voted through by the council's elected members — not just officials. After the rules are made, a notice announcing this and where copies can be bought must be published in Iris Oifigiúil and in a newspaper. If any of these steps were skipped, a charge enforced under those rules can be challenged.
