NI Tribunal — adjudicator independence and limited written-only default
The NI Traffic Penalty Tribunal is constituted under the Traffic Management (NI) Order 2005 Sched 1 paras 8–13. Adjudicators must be barristers/solicitors of at least 7 years' standing. Tribunal decisions are made on the papers unless the appellant requests an oral hearing, which the Department cannot refuse. Many appellants do not realise oral hearings are available, and the Department can be put to fuller proof if one is requested.
Legal basis
Traffic Management (Northern Ireland) Order 2005 Sched 1 paras 8–13; Parking and Bus Lane Penalty Charge Notices (Representations and Appeals) Regulations (NI) 2008 (SR 2008/193); NI Traffic Penalty Tribunal Procedural Rules
How to identify this in your case
If appeal looks finely balanced on paper, request an oral hearing.
Sample appeal wording
Dear Adjudicator, Re: NI TPT Appeal [REF] Under paragraph 12 of Schedule 1 of the Traffic Management (NI) Order 2005 I request that the appeal be determined at an oral hearing rather than on the papers. I will require the attendance of the Civil Enforcement Officer who issued the PCN to give evidence. Please direct the Department to make the CEO available and to lodge the full pocket-book record, photographs and contemporaneous notes. Yours faithfully, [NAME]
