MUTCD Non-Compliant Signage Defense

Idaho Code §49-201 incorporates the federal MUTCD as adopted by ITD. Boise §10-15-02, Pocatello §11.36.020, Idaho Falls §6-2-1 require all parking signs to comply. A faded, missing, knocked-down, obstructed, or contradictory sign is a complete defense — the driver had no fair notice (Lambert v. California, 355 U.S. 225 (1957)).

Legal basis

Idaho Code §49-201; MUTCD §2B; Lambert v. California, 355 U.S. 225 (1957)

Sample appeal wording

[CITY] – Parking Appeals RE: Citation #[CITATION] I appeal because signage at [LOCATION] failed to provide MUTCD-compliant notice in violation of Idaho Code §49-201 and [LOCAL ORDINANCE]. Specifically: [missing / faded / obstructed / contradictory]. Photos attached. Lambert v. California, 355 U.S. 225 (1957) requires fair notice of regulatory restrictions.
