LEZ penalty notice missing required information

Every Low Emission Zone penalty notice must include 14 specific pieces of information. If any one of them is missing, the notice does not meet the legal standard and may be invalid. Common missing items include: the right to get the camera record for free, the right to appeal to a tribunal, a warning that you must not pay while a challenge is pending, the exact grounds on which you can challenge, and a statement about the 50% discount if you pay within 14 days.

Legal basis

SSI 2021/177 reg 6(5)(a)–(n); reg 8(4)(a)

How to identify this in your case

Read PCN side-by-side with reg 6(5) checklist. Missing 50% discount statement, missing ANPR-record right, missing tribunal appeal right, missing 'must not pay if rep pending', no specific reasons.

Sample appeal wording

Sample wording to adapt and send yourself — it may not fit your notice or the stage you are at. Replace the bracketed prompts with your own details; leave any case citation as it is.

Dear [COUNCIL] LEZ Team, Re: PCN [PCN_NUMBER] Representation under reg 8(1); ground reg 8(4)(a). The document purporting to be a PCN fails to comply with reg 6(5) SSI 2021/177: [List specific missing items, e.g.:] — No statement that representations may be made on reg 8(4) grounds (reg 6(5)(j)); — No statement of right to request approved-device record free of charge (reg 6(5)(n)); — No tribunal appeal right statement (reg 6(5)(m)). A document failing reg 6(5) is not a PCN. No valid PCN has been served. Please cancel. Yours faithfully, [NAME]
