Indiana Deceptive Consumer Sales Act vs Predatory Private Operators

Indiana's Deceptive Consumer Sales Act (IC §24-5-0.5) provides a private cause of action for actual damages, treble damages (up to $1,000), and attorneys' fees against any 'supplier' engaged in deceptive consumer practices in connection with a 'consumer transaction.' Several Indiana courts have treated parking-on-private-property as a consumer transaction, opening the door to DCSA claims against operators that (a) post misleading or hidden signage, (b) charge inflated 'penalties' disguised as parking fees, (c) misrepresent themselves as having governmental authority, or (d) report unverified debts to credit bureaus. Consumer Law Center of Indianapolis has used the DCSA successfully against private parking operators (2019-2023).
