First-Offender Mitigation at Administrative Hearing

SLC Code §12.96.080 authorizes the hearing officer to reduce or dismiss a citation 'in the interest of justice' on consideration of mitigating factors. SLC's published practice (and most Utah city hearing officers under similar local ordinances – Provo §9.11, Orem §17-3, West Valley §11-4) treats first-time offenders with a clean record favorably. A respectful in-person request often results in a 50-100% reduction even where no technical defense exists.

Sample appeal wording

Hearing Officer, I accept that the vehicle was [parked over the limit / in the wrong zone] on [DATE]. This is my first parking citation in [CITY] in [N] years (records request attached). Mitigating circumstances: [medical appointment ran long / unfamiliar with zone / passenger was disabled]. I respectfully request that the citation be dismissed in the interest of justice under §12.96.080, or alternatively reduced to a warning. I have already [paid the meter / parked legally and won't repeat]. Thank you for your consideration. [NAME] / [DATE]
