Express Lane Citation – No Permit Sale Defense

Utah's I-15 Express Lanes are governed by Utah Code §72-6-118 and Utah Admin. Code R940-6. Solo drivers may use the lanes only with a valid Express Pass transponder; a violation issued by license plate camera carries a $50–$260 fee. Defenses include (a) the vehicle had two or more occupants (HOV exemption – produce affidavits/photos), (b) the transponder was active and valid (UDOT can verify), (c) signage at the entry point did not provide adequate notice (MUTCD violation), (d) the camera/license-plate read was misidentified (request the photo). Failure of UDOT to mail the notice within 30 days of the violation under R940-6-12 is also a defense.
