Bus Lane Off-Hours Parking

A bus lane only operates during the hours shown on its information plate. That is what the regulation says: article 32(2) of the Road Traffic (Traffic and Parking) Regulations 1997, as substituted in 2024, prohibits entering a bus lane "during the period of operation of the bus lane indicated on an information plate". Outside those hours there is no prohibition and no offence. So do not rely on what bus lane hours usually are — photograph the plate at the location and read it. Two things to check as well. The vehicles allowed in at any time are a large public service vehicle, a pedal cycle, an L1e-A e-moped and an electric scooter, so if you were on a bike or an e-scooter the hours do not matter. And a contra-flow bus lane, or a street signed as bus-only, is a different provision — check which one you were in before relying on this.

Legal basis

Road Traffic (Traffic and Parking) Regulations 1997 (SI 182/1997), article 32(2) AS SUBSTITUTED by article 4(f) of the Road Traffic (Traffic and Parking) (Amendment) Regulations 2024 (S.I. No. 222 of 2024): "A person shall not enter a bus lane with a vehicle, other than a large public service vehicle, a pedal cycle, an L1e-A e-moped or an electric scooter, during the period of operation of the bus lane indicated on an information plate." The prohibition therefore applies only during the period shown on the information plate, and outside that period article 32(2) imposes no prohibition. Article 32(1) prescribes the signs: a bus lane is indicated by traffic sign RUS 028 or RUS 029 used with RRM 024, and a contra-flow bus lane by RUS 030 with RRM 024. Article 32(3), also substituted in 2024, governs contra-flow bus lanes, and article 32(4) bus-only streets; neither carries the hours qualification in the same terms. NOTE ON VERSIONS: article 32 has been amended at least three times — by S.I. No. 441 of 1998, by Regulation 16(l) of S.I. No. 332 of 2012 (which substituted it) and by S.I. No. 222 of 2024 (which substituted sub-articles (2), (3) and (4)). The Irish Statute Book publishes instruments as made and does not consolidate them, so the 1997 page alone is not the current law.

Deadline. A late submission can be turned down without your argument being read. Check your notice for the deadline and how it is counted.
Paying may end it. Paying can count as accepting the notice and can close a challenge already under way. Part-paying or acknowledging an old debt can also revive a time limit that had expired.

Careful what you volunteer. Avoid unnecessary admissions — naming the driver or accepting responsibility can remove arguments. But answer anything you are legally required to answer, and do include the evidence your ground needs.
Keep the record. Keep what you sent, the attachments, any receipt, and the reply. Note the next deadline.
