Blue Badge holder exempt from Scottish clean air zone

Scotland's clean air zones in Glasgow, Aberdeen, Dundee, and Edinburgh do not apply to vehicles driven by, or carrying, a valid Blue Badge holder. If you or your passenger held a valid Blue Badge on the day the penalty was issued, the fine should be cancelled when you appeal — even if you did not register in advance through the Transport Scotland permits portal.

Legal basis

Low Emission Zones (Emission Standards, Exemptions and Enforcement) (Scotland) Regulations 2021 reg 7; Equality Act 2010 s 20

How to identify this in your case

Your penalty notice was issued by one of the four Scottish clean air zones (Glasgow, Aberdeen, Dundee, or Edinburgh), and either you or a passenger in the vehicle held a valid Blue Badge on the date of the alleged offence.
