Ticket for parking on a taxi rank? Know your fight

What this ticket is

A civil Penalty Charge Notice for waiting on a taxi rank — a stretch of road reserved for licensed taxis (hackney carriages). A private car, or a minicab or private-hire car, is not allowed to wait there, including to drop off or pick up a passenger. Ranks are enforced by civil enforcement officers on the street, and by camera where that is permitted.

The law

A rank is created by the council’s (or TfL’s) Traffic Regulation Order (Road Traffic Regulation Act 1984) and must be shown by the prescribed “TAXIS” bay marking, plus any time-limit plate, under TSRGD 2016. Enforcement and appeals sit under the Traffic Management Act 2004 (Part 6): you make representations, then can appeal to an independent tribunal (London Tribunals, or the Traffic Penalty Tribunal outside London).

   The rank only operates at set hours and you stopped outside them, so the bay was ordinary road at the time.

   You were not actually on the rank

   The footage or photos do not clearly show your vehicle waiting within the marked rank.

   Licensed taxi entitled to use it

   Your vehicle is a licensed hackney carriage with a rear licence plate, so it was allowed to wait there.

   Forced or directed stop

   You stopped only because a police officer directed you, an emergency vehicle needed room, or you could not move on for reasons outside your control.

   Procedural error on the PCN

   Wrong details, missing mandatory wording, or notice served outside the time limits.

How to fight it

1. Don’t pay yet — it usually ends your right to challenge.
2. Go back and photograph the bay markings and the taxi-rank sign, including any hours shown on the plate.
3. Note when you stopped and why — especially if it was outside the rank’s hours or you were directed to stop.
