Moving traffic ticket? Know your fight
Camera moving-traffic PCNs turn on sign visibility, the footage, and whether entry was forced. Here is the law and the strongest grounds.
What this ticket is
A civil, usually camera-enforced Penalty Charge Notice for a moving-traffic contravention — a banned turn, no entry, going the wrong way, a restricted route, a mandatory cycle lane, or a pedestrian zone.
The law
These restrictions sit under the council’s Traffic Regulation Order (Road Traffic Regulation Act 1984); signs and markings must comply with TSRGD 2016. In London, moving-traffic enforcement runs under the London Local Authorities and Transport for London Act 2003; councils elsewhere in England gained these powers under the Traffic Management Act 2004 (Part 6) from 2022. Either way you can make representations and appeal to an independent tribunal.
Key facts
- •Civil penalty — no points, no criminal record.
- •The restriction’s signs must be clear, correct and visible in good time.
- •Brief or forced entry (a hazard, an emergency vehicle, being directed in) can be a defence.
- •The camera footage must clearly show the contravention.
Strongest ways to fight it
Common appeal angles to check — every ticket is different. Beat It checks all of these against your actual ticket.
- 1
Signage inadequate or hard to see
Signs missing, obscured, contradictory or non-compliant with TSRGD.
- 2
Forced or unavoidable entry
You had to enter — a hazard, an emergency vehicle, or being directed by traffic flow.
- 3
Insufficient evidence
The footage doesn’t clearly show the contravention or the vehicle.
- 4
Permitted vehicle / route
Your vehicle or movement was actually allowed.
- 5
Procedural error on the PCN
Wrong details, missing mandatory wording, or notice served outside the time limits.
How to fight it
- Don’t pay yet — it usually ends your right to challenge.
- Replay the council’s footage and look for the signs as a driver would see them.
- Photograph the junction/signs from the approach.
- Submit your formal challenge in writing before the deadline.
- Let Beat It build the case and write it up.
